Terms Of Service

1 - General Terms

  • By ordering a commission with the Artist, you agree these Terms Of Service.

  • By ordering a commission with the Artist, you submit that you are at least 18 years of age.

  • All communication is in English only.

  • The Artist is generally available for a commission inquiry at any time. A lack of response to an opening message is not necessarily a lack of notice, as the Artist may be too overwhelmed with their current workload. The Artist will respond to inquiries when their current workload allows, or may ask to put any potential Client on a waitlist.

  • All commissions are approved only at the Artist's discretion. The Artist reserves the right to refuse any commission request without explanation.

  • The Artist reserves the right to cancel any in-progress commission at any time, without explanation. A commission which the Artist cancels entitles the affected Client to a significant if not complete refund, and will be handled on a case-by-case basis.

2 - Payment & Refunds

  • All payments are in USD and will be conducted through PayPal invoice. Unpaid invoices will be cancelled after 7 days unless otherwise agreed upon.

  • Payment is taken upfront before any commission work will begin.

  • Payment plans are available only at the artist's discretion and will be established on a case-by-case basis. Commission work will be completed in stages proportional to the fulfilled stages of the payment plan.

  • Current regular commission prices and offerings are reflected under Commission Info. The Artist is also open to discussing potential commissions not reflected under Commission Info.

  • Receiving a commission quote does not guarantee acceptance. A quote remains valid for 6 months, even if regular commission prices and offerings change. A modification to the quoted commission will result in a new quote.

  • Any deadline must be communicated and agreed upon with the Artist prior to accepting a commission.

  • The Client may request to cancel a commission at any time and request a refund. At the artist's discretion, a refund amount will be proportional to the amount of work already completed. A full refund will only be granted if no work had yet been started on the Client's commission. No refund will be given if an artwork is completed or appreciably near completion. The Client retains the rights to the incomplete artwork and any in-progress update upon the issuing of a refund.

3 - Commission Process

  • By providing reference materials, you declare you have the proper rights or permissions to use said materials. For group commissions, a single representative must handle all communication with the Artist.

  • If the commission type allows, the Artist will provide sketches to the Client seeking final approval of the commission, before detail work and illustration begins.

  • Any significant commission work required prior to the final approval stage of the commission, such as storyboarding for a comic, may count as a separate commission and be charged separately, at the Artist's discretion. This type of work is normally already factored into the regular commission prices.

  • Changes to the project scope after initial payment, such as the inclusion of additional characters, will require additional approval and fees. The Artist reserves the right to reject any change in project scope and issue a proportional refund.

  • Revisions and edits to a commission can be requested at any time prior to the completion of the artwork, but may require additional fees depending on the scope of the changes and the overall progress of the commission. Revisions are most welcome before the final approval stage, before the Artist begins painting, and are unlikely to incur additional fees; if an approval stage is provided per the commission type.

  • The Client is accountable for the accuracy and detail of provided reference materials and descriptions. If the Artist misses a detail, feature, accessory, etc. provided by the reference material, this error will be corrected at no additional cost.

  • Generally, more expensive commissions have a greater time investment and more frequent communication between the Artist and the Client. This includes the Artist providing in-progress updates. Shorter and smaller commissions are less likely to include an approval stage or in-progress updates, and require less frequent communication; at the Artist's discretion.

  • The completed commission will be delivered in at least two forms: a full-sized image ideal for the Client's personal use, and a smaller version ideal for sharing on social media. Files will be delivered through Discord or, if communication is hosted on a different platform or upon the Client's request, will be delivered by email.

4 - Communication

  • The Artist is best reached through Discord and can be found through their Discord server. The artist prefers to communicate through Discord private messaging for ease of communication, and may request to transition to Discord if communication begins on a different platform.

  • The Artist will attempt to complete and deliver the finished commission at their earliest convenience and within a reasonable amount of time. Commissions are not expected to be worked on in the order in which they are accepted.

  • Turnaround time for any given commission is not measured, and largely dependent on the scale of the commission and the Artist's combined workload. However, unless otherwise stated, a commission can be expected to be completed in less than 3 months from the Artist receiving payment. The Artist assumes no deadline for a commission to be completed, unless an agreement is made with the Client prior to beginning work. Deadlines requested after a commission has been accepted may be accommodated, at the Artist's discretion.

  • The Artist may reach out to the client at any time regarding their commission for clarification of the work or to provide an in-progress update.

  • The Client can request an update on the progress status of their commission at any time.

  • The Artist will notify the Client of any significant work delays resultant from outside events.

5 - Copyright & Usage

  • The Artist retains all rights to the artwork. This includes any declined and altered designs, cancelled sketches, and any other in-progress updates shared with the Client prior to the completion of the artwork. The Artist's rights includes but is not necessarily limited to: the ability to display, distribute, or reproduce the artwork; or use the artwork for the purposes of sale and self-promotion in both online and offline contexts.

  • The Client retains all rights to their original intellectual property depicted within the artwork, including but not necessarily limited to: characters, objects, and locations. The Artist assumes no ownership of these depicted works, only the artwork itself.

  • Upon delivery of the completed artwork, the Client acquires a limited license to utilize the artwork for non-commercial purposes. This includes but is not necessarily limited to: public and private display, posting the artwork to social media, and printing for private use. Crediting the Artist is requested where applicable, but not enforceable.

  • The Client may purchase commercial rights to the completed artwork at an additional 100% of the original price of the commission.

  • Upon delivery of the completed artwork, the Client has the option to request that the Artist temporarily abstain from publicly displaying, distributing, or reproducing the artwork, or to use the artwork for the purposes of sale and self-promotion in both online and offline contexts; until such a time that they both agree upon. The Artist retains the right to decline this request or rescind this request at any time.

  • The Client may crop, rotate, mirror, or resize the completed artwork; such as to fit the dimensions of a banner or profile picture.

  • The Client may not edit the completed artwork or any in-progress updates delivered to them during the Commission Process. This includes but is not necessarily limited to: using photo editing software to add to, remove from, alter, or otherwise deface the completed artwork; having someone who is not the Artist complete a cancelled sketch; or having someone who is not the Artist repurpose a rejected design. The sole exception allowed to the Client is to run the completed artwork through a cloaking filter, such as Glaze or Nightshade, for the purposes of protecting the artwork from abuse by GenerativeAI models, LLMs, AI training models, and crypto related projects such as NFTs.

  • The Client may request to purchase limited editing rights to the completed artwork at an additional 100% of the original price of the commission. The extent of these rights will be discussed with the Client on a case-by-case basis.

  • Use of any artwork completed by the Artist or any in-progress update delivered to a Client during the Commission Process is explicitly prohibited from association with, or utilization by: GenerativeAI models, LLMs, AI training models, and crypto-projects such as NFTs. Anyone found violating this mandate will be blacklisted from future work with the Artist, have their actions publicly disclosed, and may be subject to legal action.
